Am I the only one to realise that it makes economic sense to drop into Timothy’s ($cdn1.83 for a medium regular) and fill the empty beaker with cream, than to go next door to the variety store and purchase a carton of the same cream? Timothy’s is, after all, selling me the use of an empty beaker. They don’t actually/even serve me coffee.

I don’t consume much cream; just a bit now and then in a speciality soup, or what have you.

Let’s see: return flight from Amsterdam to Toronto: 250 euro, plus taxes 300 euro ~ $CDN 450
Local transport to Amsterdam Airport: 10 euro ~ $CDN 15
Local transport in Toronto ~ $CDN 15
Medium regular at Timothy’s $CDN 1.83
Total ~ $CDN 481.83
I think I’ll go to the supermarket near my apartment…

No, you are thinking of “Timmys”, a.k.a. Tim Hortons.
This is “Timothys

*Yet another Posh Coffee Shop

Well, when I left BC in 1984 Tim’s hadn’t arrived out west. I suspect there is a thousand or so Timmy’s across the street from every Starbucks. Just what the world needs …

Ours is not all that posh; they run out of cream far too frequently.

So what? Noone else uses a coffee shop cream as a cheap source?

>Noone else uses a coffee shop cream as a cheap source?

So why not start a new thread and call it Cheap Sugar or Cheap Chocco Topping or Cheap Table and Chairs or cheap lavatory paper

If I put it in that context, would that be right, I honestly don’t think that filling up a cup full of cream is in the spirit of the law…just my 2cents

> in the spirit of the law
I suspect that the spirit of Ontario Laws would require the proprietor to provide a service (are we chaging Goods & Services tax) rather than just hand over an empty coffee beaker.
I wrote it, however, in the spirit of economics.
As far as the law goes, I am more likey to be killed while crossing the road by a scofflaw driver.
Not that the law seems to care.
Jefferson can go into the details of contract law, but I suspect it goes somewhere along the lines of:

• Timothy’s have ‘offered to treat’ by displaying a menu item “Medium Regular Coffee, $cdn1.83”
• you have agreed to this contract, and you have paid the consideration
• you are entitled to depart with the beaker of coffee with an acceptable amount of cream
By walking off with a complete beaker of cream you are in breach of the contract. I am assuming the cream costs more than the equivalent amount of coffee, otherwise you would not be doing this. The remedy would be to pay the cost for a full beaker of cream. It could be argued that you are committing fraud, by obtaining a pecuniary advantage (as we say over here). Morally, you must know that you are entirely in the wrong.

I suggest you turn yourself in to the police authorities immediately, and offer to pay the full amount you have obtained by deception back to Timothy’s. You may get off with a light sentence.

My license doesn’t cover Ontario. However, if cream has been sitting out on the counter for any period of time, its shelf life may be considerably less than the refrigerated product across the way due to the growth of bacteria and fungi deposited from the air. Mmmmmm.

• #1046826

You could give general guidance about the law of contract, perhaps, in your locality!

The fact that the purveyors don’t list “Beaker of yummy cream, $cdn5.00” (say) on their menu must indicate that they are not expecting people to leave with a beaker-full…

I suspect the additional bacteria do not form part of any contract?

John

• #1046829

I would have assumed that the additional bacteria would not have been able to legally form any part of any contract.

Sort of like half-and-half? Or 10%

I must confess that have done it again. Last Saturday. Made Cream Of Broccoli soup. Added way too much flour. It set like cement. I suppose that makes me a hardened creaminal.
I shan’t do it again. I am a changed man. Better lait than never.
