Its a sad day when Small Claims Court procedures are now a relevant topic for a website devoted to Windows and Office.

I once filed a claim against a software retailer for selling me bad (i.e. uninstallable), and essentially pirated software (unbeknownst to me at the time).
The retailer eventually settled out of court, but I did not recover my full claim which included interest, taxes, and court costs.
When I asked the court clerk about this, she said that I would have to file a separate claim, which didn’t make sense to me.
I accepted what I got, rather than go through the whole process again.

Generally, acceptance of a settlement customarily includes appropriate and enforceable releases so you have no further claims.

If you didn’t think the settlement offer was sufficient your next step would be to decline to settle and roll the dice to continue litigating for your full claim.

You are right, but I didn’t know that at the time.
I thought that I could collect the money offered, and continue on with the case to collect the rest of what I was owed.
I wouldn’t make that mistake again.

Woman wins $10k from Microsoft over Windows 10 misery

I wonder if a suit could also be filed by someone that had to spend endless hours in researching patches/problems that didn’t actually upgrade to Windows 10?

Also curious as to whether a class-action lawsuit or a LOT of small claims cases would be more effective.

Even with Microsoft again modify the update process at the 11th hour (snicker) it doesn’t suitably address other issues that many find disconcerting such as forced updates, telemetry, insufficient documentation, etc…

Everything works *perfectly* for me in Windows 7 Professional 64bit.

I’m no longer a gamer (as I was in an earlier incarnation) and am wary of how they will price/market and make product decisions leaving out the customer perspective.

They’ve put themselves in the position of losing a lot of trust and it’s not going to be earned back by this late update change.
